Who&#039;s making the payments on the mortgage? How long has he been making the payments on the mortgage? Since he is the only one actually paying for the house, he should be able to have say in who sells it. Hes being SMART by waiting. He wants to get the value out of the house, so you both don&#039;t end up owing the bank money on the mortgage. Don&#039;t sell the house just because your being pissy about the breakup. That&#039;s a good way to lose out on at least some return from your initial investment. And switching agents won&#039;t help if no one is buying houses. Your just burning more money.

As for only him paying the mortgage, yes, he can claim that back from you. Either by taking a larger portion of the sale value of the house. Or taking you to court. And, assuming he has proof. He will win.

Why are you in such a hurry to sell the house? If you really want the house gone that much, then sign the mortgage over to only his name. He obviously has no problem paying his bills on the full mortgage. Until you pay your share, I personally don&#039;t think you should have a say. And legally, if he can prove hes the only one making payments, the courts won&#039;t think you have a say either.</description>

The housing market is pretty bad right now, what is it about your current agent that you have a problem with?  Is it lack of photo&#039;s, virtual tour, lack of advertising, what can you do with the property to make it more attractive to buyers.  Why don&#039;t you sit down with the agent and see what they recommend.  But if there are no buyers it wouldn&#039;t matter if the house was paved in gold.  best of luck.  
A Quit Claim will only get you off the deed, not off your obligation of the mortgage.   The only way to be removed from the mortgage is to have him refinance the home is his name only.</description>
