Can my ex take more of the share of the equity than me after temporary split up previously.?

Me and My ex broke up temporarily, in that time i got rented accomodation as he was going to buy me out of my share. However 6 weeks down the line we decided to give it another go, however he didn’t want me to move back into the house. He was happy to pay it until we were solid again and i moved back in. (obviousley i was paying rent etc. After a year i moved back in and started paying my share again.

Fast forward 2 years. We have broken up for good now and have been trying to sell the house. Still both paying equally. However he wants to be re-imbursed the "year out" i had when we finally sell the house. Which equates to about £3k interest and £1.5k off the capital.

I don’t think this is fair as i also had to pay out in rent and bills, and he was the one who didn’t want me to move back in. Has he got any legal leg to stand on?

    It depends on the mortgage agreement if it is a joint tenancy you both have an equal share so by rights no he can’t. If it’s a tenancy in common it is a bit more complicated but at the end of the day you have to do what feels right but legally he hasn’t a leg to stand on if it’s a joint tenancy

    live together or not – if the laws in the UK are that you have equal ownership of assets and liabilities then its a 50-50 split – UNLESS!!!! both of you agree to something other than that -

    as long as you didn’t sign anything giving him majority share, you are entitled to half, so talk to an attorney and get some assistance, good luck
